II. Scope and Definitions

1. These General Terms and Conditions – hereinafter referred to as "GTC" – apply to all product orders made by you via the website https://mastswissdesign.com/ and to all other legal transactions concluded between you and us, MAST Swiss Design by Haltho AG, through the use of this website. The website is hereinafter referred to as the “MAST Swiss Design Online Shop.”
2. Our MAST Swiss Design Online Shop is aimed exclusively at consumers.
3. By placing an order in our online shop, you confirm that you have the legal age required in your country to enter into binding contracts.

III. Conclusion of the Purchase Agreement

1. Order and Steps to Conclusion of Contract

• (1) The products displayed in the MAST Swiss Design Online Shop do not constitute a binding offer on our part but are an invitation for you to make a binding purchase offer.
• (2) You can register as a new customer before your first order or at a later point. However, you can also place an order as a guest without registration. Required fields during registration or ordering must be filled in truthfully. Voluntary information must also be truthful.
• (3) By clicking the “Add to cart” button, you can place items into a virtual shopping cart without obligation. The cart can be viewed by clicking the cart icon. Items can be changed or removed from the cart.
• (4) By clicking “Proceed to checkout,” you will be asked to enter personal data and select a payment and shipping method, unless already provided during registration. You will be shown a summary of your order before submitting it, which you must check carefully. You can correct your entries or cancel the process at any time.
• (5) By clicking the “Buy now” button, you place a binding offer to purchase the items in your cart.

2. Acceptance, Order Confirmation & Other Conditions

• (1) Upon receiving your order, we will send a confirmation email. This does not yet represent acceptance of your offer.
• (2) You will be notified by email once the goods are dispatched (shipping confirmation). Unless otherwise stated, the shipping confirmation constitutes the binding acceptance of your offer.

3. Right of Withdrawal 

• (1) As a consumer under § 13 BGB, you have the following right of withdrawal:

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date on which you or a third party named by you, who is not the carrier, took possession of the goods (or the last good in the case of multiple items in one order).
In the case of delivery in several partial shipments, the period begins when the last part is received.

You can use the sample withdrawal form provided, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send the notification before the expiry of the withdrawal period.

Consequences of Withdrawal
If you withdraw, we will refund all payments received from you, including delivery charges (except extra costs from choosing non-standard delivery), within 14 days from receipt of your withdrawal notice. The same payment method used in the original transaction will be used for the refund unless otherwise agreed. No fees will be charged for the refund.
We may withhold the refund until we receive the returned goods or you provide proof of return.
Goods must be returned within 14 days of notifying us of your withdrawal:

You bear return shipping costs unless the return is sent from within Germany. See our cost table for more details.
You are only liable for any diminished value of the goods resulting from handling other than necessary to establish the nature, characteristics, and functioning.

End of Withdrawal Instructions

• (2) Exclusions from the Right of Withdrawal:
  Under § 312g para. 2 BGB, the right of withdrawal does not apply to:
  • Custom-made goods or goods tailored to personal requirements
  • Sealed goods not suitable for return due to health/hygiene reasons if the seal is broken

5. Further Information

• (1) Your contract text will be stored and can be retrieved after completing your order.
  You can print your order details after submission. A copy will be emailed or delivered at the latest with the goods.
• (2) These GTC are available anytime under “GTC” on our website.
• (3) Contracts are concluded in either German or English, depending on your language selection.

IV. Execution of Purchase; Payment & Shipping

1. Prices, Shipping, Offers, Availability

• (1) Prices include VAT applicable at the time of order.
• (2) Flat shipping fee: €15.90 within Germany, €15.90 for other EU countries and Switzerland.
• (3) Special offers are usually limited in time. Product availability may vary. If an item is not available, you will be informed in the order confirmation or by separate email. If an item is permanently unavailable, we will not accept your offer, and no contract will be formed.

2. Payment Methods

• (1) Payment methods (we may restrict methods case-by-case):
  • Credit Card: Charged upon shipping (Amex, Visa, Mastercard)
  • PayPal: Requires a PayPal account; charged upon shipping
  • Apple Pay: Requires Apple device/account; charged upon shipping
  • TWINT: Requires TWINT app and QR scan or code input; charged upon shipping
  • Gift Voucher: Redeemable only before completing checkout; no cash refund
• (2) An invoice will be issued no later than upon delivery.

3. Delivery Times, Shipping, Risk, Partial Delivery, Delay

• (1) Delivery times listed in the shop apply to Germany. Other countries: see table.
• (2) Delivery is to the address you provide. Risk passes upon delivery or if you are in default of acceptance.
• (3) We may make partial deliveries if reasonable, and we bear extra shipping costs.
• (4) In case of late payment, we may charge default interest and damages.

4. Retention of Title; Offsetting; Withholding Rights

• (1) Goods remain our property until full payment is received.
• (2) You may only offset claims that are undisputed or legally established.
• (3) Withholding rights apply only if based on the same contractual relationship.

5. Defects and Warranty Rights
   If goods are defective or incomplete, statutory warranty rights apply.
6. Liability and Limitation

• (1) We are fully liable for intent, gross negligence, injury to life/body/health, guarantees, and product liability.
• (2) For breaches of essential duties (those enabling contract fulfillment), liability is limited to foreseeable damages unless unlimited under (1).
• (3) All other liability is excluded.
• (4) Limitations apply to our employees, representatives, and vicarious agents as well.

V. Final Provisions

1. Applicable Law and Jurisdiction
   Swiss law applies, excluding CISG. Mandatory consumer protection laws in your country remain unaffected.
2. Place of Performance
   Unless otherwise agreed or legally required, the place of performance is our business address listed in Section I.
3. Consumer Dispute Resolution
   We are neither obligated nor willing to participate in dispute resolution before a consumer arbitration board.
