Execution of the Purchase Agreement; Payment Processing; Delivery 

1. Prices and Shipping Costs; Special Offers; Availability; Delivery Restrictions 

(1) Our prices include the statutory value-added tax (VAT) applicable at the time of your order. 

(2) We charge a flat-rate shipping fee. For standard shipping within Germany, Austria, Italy, France, and Spain, the fee is EUR 15.90. For Switzerland, a flat-rate shipping fee of CHF 15.90 applies. The shipping costs will be clearly communicated to you again at the latest on the product detail page (possibly via a hyperlink). 

(3) Please note that special offers are generally only available for a limited period. The products displayed in the MAST SWISS DESIGN online shop are subject to varying availability. The availability of a product may also depend on the specifications you provide (e.g., size, color). If a product is not available, this will be indicated on the respective product page. If it turns out after receiving your order that the ordered goods are temporarily unavailable, we will inform you of this in the order confirmation or contact you (e.g., via an additional email). If the goods are permanently unavailable, we will not issue a declaration of acceptance. In this case, no contract is concluded. 

2. Payment Methods and Terms of Payment 

(1) Payment for goods is made using one of the payment methods listed below. However, we reserve the right to exclude specific payment methods in individual cases. • Credit Card: When paying by credit card, your card will be charged upon dispatch of the goods. We accept American Express, VISA, and Mastercard. • PayPal: To pay with the online payment service PayPal, you need a PayPal account. If you choose this payment method, you will be redirected to PayPal to complete the payment. Your account will be charged upon dispatch of the goods. • Apple Pay: Apple Pay is a payment method offered by Apple Inc. To use Apple Pay, you must have Apple Pay activated (e.g., on your iPhone), authenticate yourself with your login credentials, and confirm the payment instruction. Your account will be charged upon dispatch of the goods. • TWINT: TWINT is a payment method offered by TWINT AG. To use TWINT, you must have the app installed (e.g., on your iPhone). To complete the payment, you must scan a QR code or enter the code in the app. Your account will be charged upon dispatch of the goods. • Gift Voucher: Gift vouchers and the associated credit balance can only be redeemed before completing the order process. Retroactive application is not possible. The credit balance of a gift voucher will not be paid out in cash or accrue interest.

 (2) Regardless of the chosen payment method, you will receive an invoice no later than upon delivery of the goods. If the billing address differs from the delivery address, the invoice will be sent either by post to the billing address or by email to the address you provided. 3. Delivery Times; Shipping and Transfer of Risk; Partial Deliveries; Default (1) The delivery times stated in the table in the MAST SWISS DESIGN online shop apply to deliveries within Germany and are calculated from the time of our binding acceptance of your purchase offer. For information on deliveries to other countries, please also refer to the delivery time table. (2) Delivery will be made to the address you provide. Shipment will be handled by an appropriate transport company. The risk of accidental loss of the ordered goods passes to you once the goods are handed over to you or your authorized representative, or if you are in default of acceptance. 

(3) We are entitled to make partial deliveries, provided they are reasonable for you. If partial deliveries are made, we will bear the additional shipping costs.

 (4) If you are in default with your payment, we reserve the right to charge the statutory default interest. The assertion of further default damages is not excluded.

 4. Retention of Title; Set-Off and Right of Retention

(1) The goods remain our property until full payment of the invoice amount has been received. 

(2) You may only offset claims against us if your counterclaims are legally established or undisputed. 

(3) Rights of retention are only permitted if they relate to claims arising from the same contractual relationship. 

5. Your Warranty Rights

 If the goods are damaged or have another defect (e.g., incomplete delivery), you are entitled to the statutory warranty rights against us. 

6. Liability and Limitation of Liability

 (1) We are fully liable to you for intent (including fraudulent intent) or gross negligence, for negligent or intentional injury to life, body, or health, as well as for any guarantees given (unless otherwise stipulated), and for mandatory liability such as under the Product Liability Act. 

(2) In the event of a breach of essential contractual obligations, our liability is limited to typical and foreseeable damages, unless we are liable without limitation under section (1). Essential contractual obligations are those obligations whose fulfillment is necessary for the proper execution of the contract and on whose compliance you regularly rely. 

(3) In all other cases, our liability is excluded. 

(4) The above limitations of liability also apply with regard to any liability of our employees, staff, executive bodies, vicarious agents, and legal representatives.
